Terms of Service

These Terms of Service ("Terms") govern your use of the FlockTrot mobile application ("FlockTrot," "the app," "we," "us," or "our"). By creating an account or using FlockTrot, you agree to these Terms. If you do not agree, please do not use the app.

1. Description of the service

FlockTrot is a group trip-planning app for camping and outdoor trips. It lets you create trips, organize groups, share itineraries, track supplies and gear, coordinate campsite logistics, and split trip expenses with people you invite.

2. Eligibility and accounts

• You must be at least 13 years old to use FlockTrot. You must also be able to form a legally binding contract to use FlockTrot; if you are under the age of majority in your jurisdiction, you may only use FlockTrot with the involvement of a parent or guardian.
• You sign in using your Google account. You are responsible for maintaining the security of that account.
• You are responsible for the accuracy of the information you provide and the content you add to trips and groups.

3. Shared and group content

FlockTrot is built around sharing information with other people on your trip. When you create or join a trip or group:

• Content you add (itinerary events, supplies, expenses, campsite details, photos) becomes visible to other members of that trip or group.
• Invite links you generate grant access to whoever holds the link — treat them like you would any shared access credential, and only share them with people you intend to invite.
• By default, invited members can edit trip content ("write" access). You are responsible for who you invite.
• You should not upload or share content that is illegal, infringing, harassing, or that you do not have the right to share.

4. AI features

FlockTrot includes optional AI-assisted features ("FlockTrot AI") that use a third-party AI model (currently Google's Gemini) to help build itineraries and suggest transportation, lodging, restaurants, and activities, including inside a trip's group chat. By using FlockTrot AI, you also agree to the following:

• AI-generated suggestions are drafts, not verified recommendations. FlockTrot AI may suggest a hotel, restaurant, campsite, activity, address, price, or other detail that is inaccurate, outdated, or does not actually exist. Always independently verify any AI-suggested name, address, hours, availability, or price before booking, traveling to, or otherwise relying on it.
• FlockTrot AI is intended only for planning and managing the details of your own trips within the app. Don't attempt to use it for unrelated purposes, or try to bypass, manipulate, or circumvent its intended scope, its rate limits, or any safety measures we put in place.
• We may limit, throttle, or suspend access to FlockTrot AI — for a specific account or app-wide — at our discretion, including in response to overuse, abuse, or an outage or change on the part of our third-party AI provider.
• You can turn FlockTrot AI off at any time from Settings; doing so does not affect your ability to use the rest of the app.
• See our Privacy Policy for what information is sent to our AI provider when you use these features.

5. Free trips and payments

• FlockTrot currently allows a limited number of free trips per account. Beyond that, we may introduce paid features in the future.
• Any future payment processing will be handled through Google Play Billing, in accordance with Google Play's policies, and these Terms will be updated accordingly before charges begin.
• Certain accounts may be designated with unlimited access at our discretion.

6. Acceptable use

You agree not to:

• Use FlockTrot for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to other users' accounts, trips, or groups
• Interfere with or disrupt the app's functioning or servers
• Upload malicious code or attempt to reverse-engineer the app beyond what's permitted by applicable law
• Use the app to harass, abuse, or harm another person
• Attempt to bypass, manipulate, or misuse FlockTrot AI outside its intended trip-planning purpose, or attempt to circumvent rate limits or safety measures on it (see Section 4)

7. Intellectual property

FlockTrot's name, logo, and app design are owned by us. You retain ownership of the content you create (trip details, photos, notes), but you grant us a limited license to store, process, and display that content as necessary to operate the app and share it with the trip/group members you've included.

8. Copyright complaints (DMCA)

We respect the intellectual property rights of others and expect users to do the same. If you believe that content on FlockTrot infringes a copyright you own or control, send a written notice to flocktrot@gmail.com that includes:

• Identification of the copyrighted work you claim has been infringed
• Identification of the specific content on FlockTrot you claim is infringing, with enough detail for us to locate it
• Your contact information (name, address, email, and phone number)
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf
• Your physical or electronic signature

We will respond to valid notices by removing or disabling access to the reported content, and may notify the user who posted it.

9. Termination

You may stop using FlockTrot and request account deletion at any time. We may suspend or terminate accounts that violate these Terms, engage in abusive behavior, or pose a security risk to the app or other users. We may also limit, rate-limit, or suspend access to FlockTrot AI specifically for accounts that abuse, overload, or attempt to circumvent its intended use, separate from any action taken against the rest of your account.

10. Disclaimer of warranties

FLOCKTROT IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT TRIP/EXPENSE CALCULATIONS WILL BE FREE FROM MISTAKES — ALWAYS DOUBLE-CHECK IMPORTANT LOGISTICS (CAMPSITE RESERVATIONS, PAYMENT AMOUNTS, ETC.) INDEPENDENTLY. THIS INCLUDES AI-GENERATED SUGGESTIONS FROM FLOCKTROT AI — SEE SECTION 4.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FLOCKTROT AND ITS DEVELOPER ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DISPUTES BETWEEN TRIP MEMBERS OVER EXPENSES, MISSED RESERVATIONS, INACCURATE AI-GENERATED SUGGESTIONS, OR LOST TRIP DATA.

12. Indemnification

You agree to indemnify, defend, and hold harmless FlockTrot and its developer from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the app; your violation of these Terms; content you upload, share, or otherwise add through the app; your violation of any law or the rights of a third party; or a dispute between you and another trip or group member. This applies to the fullest extent permitted by law.

13. Force majeure

We are not responsible for delays, interruptions, or failures of FlockTrot caused by events beyond our reasonable control, including outages of the third-party services FlockTrot depends on (such as our cloud database, our AI provider, or the App Store or Play Store), internet or infrastructure failures, or other events of a similar nature.

14. Changes to the app and these Terms

We may modify or discontinue features of FlockTrot at any time. We may also update these Terms; continued use of the app after changes take effect constitutes acceptance of the revised Terms.

15. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of FlockTrot will be subject to the exclusive jurisdiction of the state and federal courts located in California.
